Failure to charge Somali national leaves officer reeling in straits

The Director of Immigration Services is on the spot over failure to charge Osman Ahmed Kahia, an alleged Somali national despite authorizing police officers to arrest him for being in Kenya without legal documents.

In a letter seen by People Daily, the lobby group Commission for Human Rights and Justice says the Immigration Services through Anti-Terror Police Unit (ATPU) Mombasa arrested the said individual and a charge sheet was prepared but the case has never been expedited.

“The Commission has come to the knowledge that sometime in 2020 the department of Immigration came to the knowledge of the presence of Osman Ahmed Kahia, Somali national who apart from being in Kenya unlawfully had obtained registration by false pretences. Your office through the ATPU arrested the individual and a charge sheet prepared,” reads the letter signed by Judy Ogogoh, the CHRJ Executive Director.

In the letter, the Commission wants the State to explain whether the said individual was ever charged in a court of law, convicted or acquitted and if he was convicted whether he was deported to his country of origin.

The Commission wants to know if any meaningful action was ever taken to bring the culprit to justice and demands that the immigration office should take appropriate measures against the foreigner with a view of securing the safety of the people and public property.
